These Terms and Conditions (“Terms”) govern the access to and use of the website www.malucollective.com (the “Site”) and set out the conditions for the purchase and sale of products and/or services offered by MALU (“we”, “us”, or “our”) to users (“you” or “Users”). These Terms are supplemented by our Privacy Policy and Cookie Policy, which are an integral part of this agreement.

By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms.

MALU reserves the right to modify, update, or delete these Terms at any time without prior notice. You are encouraged to review the Terms regularly. Continued use of the Site constitutes acceptance of the updated Terms.
3. Access and Use of the Site
You may browse the Site freely, view product information, and place products in your shopping cart without registration.
You must use the Site responsibly, without damaging or interfering with its features or content. Any illegal, offensive, or unauthorized content—including content protected by third-party rights—must not be uploaded or shared.
You are also prohibited from uploading files that may contain viruses or malicious code, collecting or processing data from other users and sending unsolicited communications.
4. Placing Orders
Orders can be placed without prior registration by selecting the desired products and completing the checkout process.
You are responsible for providing accurate and complete information to ensure successful processing and delivery.
Orders are processed on a first-come, first-served basis and are subject to product availability.
If purchasing multiple products in a single order, the longest delivery time will apply.
5. Pricing and Shipping
Prices are displayed in euros (€) and include applicable VAT. Prices are subject to change without prior notice and are valid only from the moment they are updated on the Site.
Prices may be shown in other currencies, calculated based on applicable exchange rates.
Shipping costs are calculated at checkout.
6. Payment Methods
We accept payments via PayPal, Apple Pay, and credit card.
These payments are processed by third-party providers and are subject to their terms and conditions. MALU is not responsible for any issues related to payment processing.
7. Order Fulfillment and Delivery
Orders are processed only after payment confirmation.
Products will be delivered to the address provided by the user, in accordance with the delivery timeline of the carrier.
You should inspect your order upon delivery and may refuse it if any visible damage is detected.
All shipments outside mainland Portugal will be accompanied by a Simplified Accompanying Document (DAS).
8. Warranty
In the event of a manufacturing defect, you may return the item at no cost. Contact us at malucollective@gmail.com within 2 days of delivery.
9. Complaints and Dispute Resolution
Complaints must be submitted within 14 days of delivery to malucollective@gmail.com.
In case of a consumer dispute, you may:

- Or contact an official Alternative Dispute Resolution (ADR) entity: https://www.consumidor.gov.pt
Submitting a dispute does not prevent you from using the Complaints Book.
10. Intellectual Property
All content, design, and layout of the Site—including trademarks, logos, text, images, and multimedia—are owned or licensed by MALU and protected under intellectual property laws.
You may not use, reproduce, distribute, or modify any content without our prior written consent.
11. Personal Data
Accessing the Site does not require you to submit personal data, unless making a purchase.
To place an order, you will be required to provide personal data such as name, email, tax ID, and delivery/billing address.
Account registration also requires your name and email.
All data is handled in accordance with our Privacy and Cookie Policies.
12. Liability and Warranties
Use of the Site is at your own risk.
We are not liable for any damages resulting from system failures, interruptions, or inaccuracies.
MALU does not guarantee the quality, availability, or performance of products or services displayed on the Site.

MALU reserves the right to suspend or terminate the Site or any of its features at any time, including for the following reasons:

- Suspected fraudulent or abusive use;

These Terms are governed by Portuguese law.
In the event of a dispute regarding their interpretation or enforcement, the Lisbon District Court shall have jurisdiction, without prejudice to alternative dispute resolution mechanisms.
